FAA plans to move faster on Hazmat investigations. The Federal Aviation Administration (FAA) will develop a plan by December 31 to speed investigations and encourage air carriers to voluntarily report hazardous materials violations.

This comes in the wake of a recent report by the U.S. Department of Transportation's inspector general (IG) criticizing the agency’s monitoring of hazardous materials, an FAA spokesperson said. “A lot of the things the IG recommended are things we are already doing or we will be doing by December 31,” FAA spokesperson Rebecca Trexler said. The report said that “improperly shipping Hazmat by air through either negligent or illicit behavior can have the same consequences as a terrorist attack,” and cited the 1996 ValuJet Florida Everglades crash that killed 110 people. That crash was blamed on a fire caused by the illegal shipment of oxygen generators in the plane’s cargo hold.
 



Company VP gets jail for hazmat violations

A New Jersey company and its vice president were recently sentenced in U.S. District Court, Philadelphia, for criminal violations of the Hazardous Material Transportation Law. In May 2004, the company and officer each entered guilty pleas stemming from a prior charge that, between January 2000 and August 2003, they had transported over 10,000 shipments of flammable butane canisters and gas-charged lighters in unmarked packages via ground delivery services in violation of DOT regulations.

The company was fined $500,000 and sentenced to four years’ probation; the company’s vice president was sentenced to one month in jail and fined $10,000. The DOT’s Research and Special Programs Administration (RSPA) assisted with the investigation, along with the Office of Inspector General (OIG).
 



Justice, DOT to crack down on hazardous cargo.

The government served notice Tuesday it is cracking down on illegal shipments of hazardous cargo that officials say could lead to accidents or be used by terrorists to mount attacks.

As part of new joint initiative by the departments of Justice and Transportation, Attorney General John Ashcroft announced that Emery Worldwide Airlines Inc. now part of
CNF Inc. -- pleaded guilty to 12 counts of violating hazardous material shipping laws and agreed to pay a $6 million fine. More than 1.5 billion tons of hazardous cargo are shipped nationwide each year by air, rail, sea and land. These include flammable liquids, pressurized gases, explosives, poisons and radioactive material. The government crackdown will target shippers who hide dangerous materials in otherwise safe cargo, obtain fraudulent licenses to carry hazardous materials or violate a variety of safe transportation practices. Shipping these materials illegally heightens the dangers posed by an accident, particularly since firefighters and other first responders would be unaware the substances were there.

Officials also worry that terrorists might use perceived lax security to ship hazardous materials or perhaps mount an attack.
